The U.S. Environmental Protection Agency (EPA) and the U.S. Department of the Army (Army) are announcing the withdrawal of an interpretive rule addressing the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA).  The agencies want to make clear that the statutory exemption of 404(f)(1)(A) still remains available for use when applicable for discharges of dredged and/or fill material associated with normal farming, silviculture, and ranching activities that are part of an established operation and that do not have as their purpose bringing an area of waters of the U.S. into a use to which it was not previously subject, where the flow or circulation of the waters of the U.S. may be impaired or the reach of such waters be reduced (see 33 CFR 323.4 for more information).

Project Description:  Union Pacific Railroad is applying for a Department of the Army permit for the discharge of dredged and/or fill material in approximately 2.31 acres of forested wetlands, 0.70 acre of emergent wetlands, and 10,299 linear feet of jurisdictional stream for the purpose of constructing a double track segment and associated ancillary features. The existing mainline would be converted to a siding track and a new mainline track would be constructed.  Additional track work would be required to remove the track segments that would no longer be necessary due to the proposed double track.  The project would include the replacement of track culverts at six locations, installation of five non-track culverts, construction of one bridge, construction of access roads, relocation of fence to accommodate the proposed right-of-way acquisition, and ancillary features such as signal pads, signal houses, private crossings, and temporary track to allow for uninterrupted service.  The project is located in Section 30, T17N-R4E, within the Ouachita River drainage basin, Ouachita Parish, Louisiana.

Project Description: Folley Beach Development, LLC, is applying for a Department of the Army permit for the discharge of dredged and/or fill material in approximately 3.81 acres of other waters for the purpose of reclaiming eroded water front for a commercial development in Union Parish, Louisiana.  The applicant is proposing an 18.91 acre development consisting of a dock, marina, bait shop, restaurant, condominiums, and a waterfront hotel.  The applicant proposes to mechanically dredge, via an excavator, approximately 12,250 cubic yards of silt/sand from the bottom of Lake D’Arbonne.  The dredged material would be deposited along the adjacent, non-wetland existing water line for reclamation.  After approximately 50-70% of the material has been placed in the fill area, a bulkhead, constructed of composite sheet piles and timbers, composite decking, and hot dipped galvanized hardware would be installed along the length of the fill area.  The bulkhead would run west to east approximately 950 feet and would be installed 50 feet off of the existing water line.  Dredged material would be placed on the eastern side of the bulkhead and protect the filled area from further erosion until the area has been filled to the required elevation.  The project is located in Section 1, T20N-R1W, within the Bayou D’Arbonne drainage basin, Union Parish, Louisiana.

On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act.  This notice is to announce that the comment period has been extended through November 14, 2014.  The comment period has been extended in response to stakeholder requests and to allow comments on new supporting materials.  The agencies expect to receive additional relevant materials from the Science Advisory Board prior to October 20, 2014, which will be placed on the docket as soon as they are available.  We encourage interested parties to periodically check the docket for updates on these materials.  The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014.  Comments now must be received on or before November 14, 2014.

on 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act.  This notice is to announce that the comment period has been extended through October 20, 2014.  Comments must be received on or before October 20, 2014.  The comment period was originally scheduled to end on July 21, 2014.

On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published a Notice of Availability and Public Comment (79 FR 22276) to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality.  The interpretive rule was effective on April 03, 2014.  The public comment period has been reopened through July 07, 2014, in response to stakeholder requests.  Comments submitted between the close of the original comment period and the re-opening of this comment period will be accepted and considered.
