The applicant’s stated project purpose is to provide additional supplies of potable and non-potable water, recharge underlying aquifers, provide recreation areas and economic development opportunities, and provide storage of flood waters that can be available for use during droughts.

Project Description: Cress Development, LLC, is applying for a Department of the Army permit for the discharge of dredged and/or fill material in approximately 0.90 acre of jurisdictional wetlands and 0.04 acre of other waters for the purpose of constructing a residential development.  The proposed project would include the construction of 156 single-family residential house lots as part of a planned development. The proposed lot size would average 9,375 square feet to 11,250 square feet (0.25 acre on average).  Approximately 12.75 acres of green space would be incorporated throughout the development.  The proposed project would also include the construction of interior roads and utilities.  The roads would be 31 feet wide and would be constructed within a 50-foot right-of-way. The roads would include a curb and gutter underground drainage system to facilitate storm water runoff through the subdivision.  The project is located in section 13 & 14, T8N-R1E, within the Big Black River drainage basin, Madison County, Mississippi.

On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act.  This notice is to announce that the comment period has been extended through November 14, 2014.  The comment period has been extended in response to stakeholder requests and to allow comments on new supporting materials.  The agencies expect to receive additional relevant materials from the Science Advisory Board prior to October 20, 2014, which will be placed on the docket as soon as they are available.  We encourage interested parties to periodically check the docket for updates on these materials.  The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014.  Comments now must be received on or before November 14, 2014.

Project Description: Mississippi Department of Transportation is applying for a Department of the Army permit to develop a 2,712-acre wetland/stream mitigation bank.  The proposed site is located in located in sections 3, 4, 9, 10, 11, 14, 15, 20, 21, 22, 29 and 30, Township 6 North, Range 2 East, Rankin County, Mississippi.  The bank sponsor proposes to develop a 2,700-acre wetland mitigation bank by restoring/enhancing 1,529 acres of bottomland hardwood forest, enhancing 82 acres of emergent wetlands, enhancing 535 acres of riparian buffers, and preserving 511 acres of existing forested habitat. The proposed work would increase the wetland function, provide species diversity, and increase the width of a wildlife corridor within the Pearl River Watershed.

On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published a Notice of Availability and Public Comment (79 FR 22276) to announce the availability of an interpretive rule regarding the applicability of the exemption from permitting provided under section 404(f)(1)(A) of the Clean Water Act (CWA) for discharges of dredged and/or fill material associated with certain agricultural conservation practices based on the Natural Resources Conservation Service (NRCS) conservation practice standards that are designed and implemented to protect and enhance water quality.  The interpretive rule was effective on April 03, 2014.  The public comment period has been reopened through July 07, 2014, in response to stakeholder requests.  Comments submitted between the close of the original comment period and the re-opening of this comment period will be accepted and considered.
