Public Notices
"The decision whether to issue a permit is based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest" (33 CFR 320.4(a)). In order to better evaluate the detriments and benefits of a project to the public, input is solicited from the public at large. The major tools used to interact with the public are the public notice, public hearing and input from other interested parties. Public notices are issued within 15 days of receipt of all requested information to make an application complete. Comments in response to public notice accepted for 15 to 30 days, unless U.S. Fish and Wildlife Service or the Environmental Protection Agency requests and are granted an extension. Comment period is not to exceed 60 days. Public hearings usually require a separate notice; the hearing may not occur earlier than 30 days from the date of that notice. The Corps of Engineers, Regulatory program, regulates work and structures that are located in, under or over navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899, the discharge of dredged or fill material into waters of the United States under Section 404 of the Clean Water Act, and the transportation of dredged material for the purpose of disposal in the ocean (regulated by the Corps under Section 103 of the Marine Protection, Research and Sanctuaries Act). "Waters of the United States" are navigable waters, tributaries to navigable waters, wetlands adjacent to those waters, and/or isolated wetlands that have a demonstrated interstate commerce connection.

Permits

Application procedures may vary slightly from Corps District to Corps District due to State requirements and the type of permit appropriate to the activity. Individual permits require a formal application form (ENG 4345). Some general permits and nationwide permits require pre-construction notification to the Corps in an abbreviated format. Other nationwide permits are granted automatically without contacting the Corps. If you have questions about which type of permit to apply for, please contact us.

Standard Permits

A standard, or individual, permit is one evaluated through the typical review procedures which includes a public notice, opportunity for a public hearing, and receipt of comments. A final decision is made following a case-by-case evaluation of a specific activity and is based on the outcome of the public notice process and a determination of the benefits versus losses. Standard permits are usually evaluated within 120 days after the submittal of a complete application packet.

Letters of Permission

Minor structures that do not qualify for Regional-General or Nationwide permits, Letters of Permission are types of standard permits that are issued in an abbreviated manner. If work is minor or routine with minimum impacts and objections are unlikely, then it may qualify for a Letter of Permission (LOP). These types of permits are evaluated by State and Federal agencies and adjacent property owners for 15-days and typically approved in 45-60 days.

Regional General Permits

Regional-General permits are issued for a category or categories of activities when; those activities are substantially similar in nature and cause only minimal individual and cumulative environmental impacts; or would result in avoiding unnecessary duplication of the regulatory control exercised by another Federal, state, or local agency, provided it has been determined that the environmental consequences of the actions are individually and cumulatively minimal.

Nationwide Permits

Nationwide permits are issued on a regional and nationwide basis and strive to streamline the approval process for certain types of undertakings that have minimal impacts to aquatic resources. In many cases the formal evaluation of a permit application is not required because nationwide permits have already been issued to the public at large by the Corps of Engineers and Congress. Examples include fish and wildlife harvesting devices; structures for the exploration, production, and transportation of oil, gas, and minerals; and activities required for the construction, expansion, modification, or improvement of linear transportation projects.
